These Terms of Service ("Terms") govern your access to and use of the website yourpersonality.com.au (the "Website") and the Your Personality Profiler assessment (the "Service"), provided by Career Smart International (ACN 626 059 774) ("we", "us", "our").
By accessing the Website, purchasing access, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Website or the Service.
1. Eligibility
To purchase the Service, you must be at least 18 years of age and able to form a legally binding contract.
The Service may be taken by participants under the age of 18, with a minimum participant age of 15. Where the participant is under 18, the Service must be purchased by a parent or guardian, who must:
- Be at least 18 years of age;
- Agree to these Terms on behalf of themselves and the participant;
- Consent to the collection and use of the participant's personal information as described in our Privacy Policy; and
- Supervise the participant's use of the Service as appropriate.
By purchasing the Service for a participant under 18, you confirm that you are the participant's parent or guardian and that you provide this consent. We do not knowingly allow participants under the age of 15 to use the Service.
2. The Service
The Service is an online personality and career profiling assessment consisting of a questionnaire. On completion, you receive a profile and related results based on your responses.
The Service is provided for general informational and self-development purposes only. It is not professional career, psychological, medical, financial or legal advice, and should not be relied upon as a substitute for advice from a qualified professional. Results are based on the responses you provide and the assessment methodology, and are intended as a guide only.
3. Accounts and access
To access the assessment, you must register and create an account, and purchase the relevant access plan. You are responsible for:
- Providing accurate and complete information;
- Maintaining the confidentiality of your login details; and
- All activity that occurs under your account.
Where the participant is under 18, the parent or guardian who purchased the Service is responsible for the account and for supervising the participant's use of it.
Access to the assessment is granted for the duration specified in the access plan you purchase. You must not share your account or access with any other person, except that a parent or guardian may permit the participant for whom the Service was purchased to use it.
4. Purchases and payment
The price of the Service is displayed on the Website at the time of purchase and is in Australian Dollars (AUD), inclusive of GST where applicable. Payment is processed securely by our third-party payment provider, Stripe.
By completing a purchase, you authorise us (via Stripe) to charge the applicable amount to your chosen payment method. We reserve the right to correct any errors in pricing and to refuse or cancel any order where an error has occurred.
5. Refunds
Refunds are dealt with in accordance with our Refund Policy, which forms part of these Terms. Nothing in these Terms excludes your rights under the Australian Consumer Law.
6. Acceptable use
You agree that you will not:
- Use the Website or Service for any unlawful purpose;
- Attempt to gain unauthorised access to any part of the Website, accounts, or systems;
- Interfere with or disrupt the operation of the Website or Service;
- Copy, reproduce, distribute, resell or commercially exploit any part of the Service or its content without our written permission;
- Use any automated means to access or collect data from the Website.
7. Intellectual property
All content on the Website and within the Service — including the assessment questions, methodology, profiles, results, text, graphics, logos and design — is owned by us or our licensors and is protected by intellectual property laws.
You are granted a limited, personal, non-transferable licence to access and use the Service and your results for your own personal, non-commercial use. The personality and career profile results generated for you are provided for your personal use. No other rights are granted.
8. Disclaimers and limitation of liability
The Service is provided on an "as is" and "as available" basis. While we take reasonable care in providing the Service, we do not warrant that the Website will be uninterrupted, error-free, or free from viruses or other harmful components.
Our liability to you is governed by the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
To the extent permitted by law, and subject to the consumer guarantees that cannot be excluded:
- We are not liable for any indirect, incidental or consequential loss arising from your use of, or inability to use, the Website or Service; and
- Where our liability can be limited, our total liability to you is limited, at our option, to re-supplying the Service or paying the cost of having the Service re-supplied.
You acknowledge that the Service provides general information only and that any decisions you make based on your results are your own responsibility.
9. Third-party services
The Website relies on third-party services, including Wix (hosting) and Stripe (payments). Your use of those services may also be subject to their own terms and policies. We are not responsible for the acts or omissions of third-party providers.
10. Suspension and termination
We may suspend or terminate your access to the Website or Service if you breach these Terms, or where reasonably necessary to protect the Website, other users, or our legitimate interests. Termination does not affect any rights or obligations that accrued before termination.
11. Changes to these Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Website or Service after changes are posted constitutes your acceptance of the updated Terms.
12. Governing law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia.
